Sec. 7.18.
Open Market Purchases
Where it is determined, by
policy promulgated by the Director, that it is either not
practical or not advantageous to the City to conduct competitive
sealed bidding or competitive sealed proposal procedures,
purchases may be made in the open market without newspaper
advertisement and without strictly observing the procedures
prescribed in Sections 7.16 and 7.17.
A. Minimum
Number of Bids. All open market purchases shall, whenever
feasible, be based on at least three (3) competitive bids, and
shall be awarded to the lowest responsible bidder in accordance
with standards established in this Code.
B. Notice Inviting Bids. Bids shall
be solicited by:
1. Direct mail request to prospective
vendors;
2. Telephone;
or
3. Public
notice posted in the Bureau of Purchasing and Materials
Management, 4th floor of City Hall.
C. Recording.
The Director shall keep a record of all open market orders and the
bids submitted in competition thereon, and such records shall be
available for public inspection after opening.
D. Purchase
from Federal, State, County and other City Contracts. The
Director shall have authority to purchase directly from federal,
state or county contracts or from other city contracts for
cooperative purchasing in accordance with procedures promulgated
by the Director.
