Some Exemptions from Fair Housing Laws - A Cursory Glimpse

Exemptions are determined based on carefully constructed, detailed guidelines.  The following is a brief glimpse of exemption rules; however, OHR should be contacted for details pertaining to individual situations.  That being said, in general terms, certain sales and rentals are exempt from housing discrimination laws and include the following.
  1. The sale or rental of a single-family house sold or rented by an owner if the owner does not own more than 3 single-family houses at any one time;

  2.  
  3. The sale, rental, or occupancy of dwellings owned or operated by religious organizations, associations or societies for other than a commercial purpose to persons of the same religion;
     
  4. The sale, rental, of housing for the elderly, i.e., intended for, and occupied solely by persons 62 years of age or older.

Also, private clubs not open to the public, and as incident to their primary purpose, provide lodging that they own or operate for other than a commercial purpose, may limit the rental or occupancy of that lodging or give preference to their members.
